Interview with Steve Bliss on Trusts

Reporter Name: Jenny Miller

Today, I’m speaking with renowned Wildomar Trust Attorney Steve Bliss about the complexities of estate planning and the crucial role trusts play in securing a family’s future.

Steve, for those unfamiliar, can you explain what a trust is and why someone might consider establishing one?

A trust is a legal entity that holds and manages assets for the benefit of designated individuals. It’s like a safe container for your belongings – money, property, investments – with specific instructions on how they should be used and distributed.

People establish trusts for various reasons. A common motivation is to avoid probate, a lengthy and often expensive legal process that occurs after someone passes away. Trusts allow assets to transfer directly to beneficiaries, bypassing probate court altogether. This can save time, money, and emotional stress for loved ones during an already difficult period.

Moreover, trusts offer privacy. Unlike wills which become public record, the terms of a trust remain confidential.

You mentioned avoiding probate. Can you elaborate on why that’s so important?

Probate can be a real headache. It involves court proceedings, legal fees, and public scrutiny of your financial affairs. It can take months or even years to complete, leaving beneficiaries in limbo.

Consider this: according to the American Bar Association, probate costs typically range from 3% to 8% of the estate’s value. For a larger estate, that’s a significant chunk of money.

Conversely, assets held in a trust are distributed outside of probate, saving time, money, and preserving your family’s privacy during a vulnerable time.

What type of trusts do you see Wildomar residents utilizing most often?

The majority of my clients opt for Revocable Living Trusts. These are incredibly versatile and offer a high level of control to the grantor – the person setting up the trust.

During their lifetime, they can manage the assets within the trust, make changes as needed, and even dissolve it entirely if circumstances change. It becomes irrevocable upon their passing, ensuring a smooth transfer of assets according to their wishes.

Are there any common challenges you encounter when helping clients set up Revocable Living Trusts?

Ordinarily, setting up a trust is straightforward. However, sometimes clients underestimate the importance of keeping beneficiary designations up-to-date. I remember one case where a client had named their ex-spouse as a beneficiary years ago and forgotten to update it after their divorce.

This oversight caused considerable confusion and heartache for the family when the client passed away. Thankfully, we were able to work with them to resolve the issue through legal means. It underscored the critical importance of regularly reviewing your trust documents and ensuring they reflect your current wishes.

Steve, what would you say to someone in Wildomar who is unsure if they need a trust?

My advice is simple: Don’t wait until it’s too late. A consultation with an experienced trust attorney can help you determine the best course of action for your unique circumstances. It’s an investment in peace of mind, knowing that your loved ones will be taken care of according to your wishes.
