Interview with Steve Bliss, Wildomar Estate Planning Attorney

Reporter: Brenda Newsome

Brenda Newsome sat down with local estate planning attorney Steve Bliss to discuss the crucial topic of estate planning and why it’s essential for everyone, regardless of age or financial status.

Steve Bliss on Crafting a Will or Trust

Brenda: “Steve, you work with clients on all aspects of estate planning. Can you elaborate on one of the key steps involved in this process? “

Steve: “Certainly, Brenda. One of the most fundamental steps is crafting a will or trust. This legal document serves as the cornerstone of your estate plan, outlining exactly how you wish for your assets to be distributed after your passing. It also addresses guardianship arrangements for minor children if necessary. Think of it as a roadmap for your loved ones, ensuring your wishes are honored and minimizing potential conflict or confusion during a difficult time.”

Brenda: “Why is choosing between a will and a trust so important?”

Steve: “That’s a great question. A will dictates the distribution of assets after death and goes through probate court, which can be a lengthy and public process. Conversely, a trust allows for greater control and privacy. Assets held in a trust are managed by a trustee you designate, bypassing probate altogether. Consequently, this can save time and money for your beneficiaries.”

A common misconception is that trusts are only for the wealthy. However, they can be incredibly beneficial for anyone wanting to protect their assets, provide for loved ones with special needs, or minimize estate taxes. Ordinarily, I work closely with clients to determine whether a will or trust best aligns with their individual circumstances and goals.

I recall one instance where a young couple, expecting their first child, came in wanting to ensure their assets were protected for their future family. They had modest savings but wanted to create a stable foundation. We decided on a revocable living trust, which provided flexibility and control while shielding their assets from potential creditors.

The Importance of Estate Planning

Brenda: “Are there any common mistakes people make when it comes to estate planning?”

Steve: “Yes, unfortunately. One of the biggest is procrastination. Many people assume they have plenty of time or that estate planning is only for older individuals. However, unforeseen circumstances can arise at any age. Moreover, failing to update your estate plan as your life changes can lead to unintended consequences.

Recent data from Caring.com shows that nearly 60% of Americans don’t have a will. That’s a staggering number considering the peace of mind and protection a well-structured estate plan provides.

“Remember, Brenda,” Steve added with a smile, “estate planning isn’t just about money; it’s about safeguarding your loved ones and ensuring your legacy lives on.”
