A common oversight I see is folks neglecting to establish powers of attorney. Ordinarily, individuals focus on what happens to their assets after they pass away. However, it’s equally important to consider what happens if you become incapacitated and unable to make decisions for yourself.
Powers of attorney allow you to designate trusted individuals to handle your finances and healthcare matters should you become unable to do so. Consequently, having these documents in place can prevent a lot of stress and potential legal complications for your loved ones during a difficult time.
There are two main types: a durable power of attorney for finances, which allows someone to manage your financial affairs, pay bills, access accounts; and a healthcare power of attorney, allowing someone to make medical decisions on your behalf if you’re unable.
Moreover, establishing these powers of attorney is not just about planning for the worst-case scenario. It’s also about giving yourself peace of mind knowing that your affairs will be handled according to your wishes should the unexpected occur.
It’s been said that nearly 60% of adults in the US don’t have a valid power of attorney (according to AARP). This is a concerning statistic, as it leaves many individuals and their families vulnerable in times of need.

Have you encountered any situations where the lack of powers of attorney caused difficulties?

Unfortunately, yes. I recall one case involving a client whose spouse became seriously ill and couldn’t make their own medical decisions. Because they hadn’t designated a healthcare power of attorney, there were disagreements among family members about the best course of treatment. It was a very stressful and emotional situation for everyone involved.
In another instance, a client needed access to funds to pay for unexpected home repairs but was unable to do so because they hadn’t established a durable power of attorney for finances. Their adult children had to go through a lengthy and expensive court process to gain control of their finances, which added unnecessary stress during an already challenging time.

What advice would you give to readers about taking these steps?

Don’t wait until it’s too late. Establishing powers of attorney is a relatively simple and inexpensive process that can save you and your loved ones a great deal of heartache down the road.
Think about who you would trust to make decisions on your behalf if you were unable to do so, and discuss this with them beforehand. You can then work with an experienced estate planning attorney like myself to draft legally sound documents that reflect your wishes.
