Today I had the pleasure of speaking with Steve Bliss, a seasoned probate attorney here in sunny San Diego. Steve, can you tell us a little about the probate process in San Diego?
“Certainly,” Steve began. “Probate is essentially a legal process that occurs after someone passes away. It involves validating their will (if they had one), identifying and inventorying their assets, paying off debts and taxes, and ultimately distributing the remaining estate to the beneficiaries.”
The Importance of Inventorying Assets
Steve explained that one crucial step in probate is marshaling the estate assets. “This involves meticulously inventorying all of the deceased person’s possessions,” he said. “Think of everything from bank accounts and real estate to vehicles, jewelry, and even personal belongings.
We then need to determine the fair market value of these assets. This step is critical because it helps ensure that debts are paid fairly and that the beneficiaries receive their rightful share of the estate.” Consequently, Steve emphasizes the importance of accurate recordkeeping throughout a person’s life, as this can greatly simplify the inventory process.
Challenges and Triumphs
Steve shared a story about a client whose deceased spouse had been an avid collector. “We discovered hundreds of rare coins stashed away in a safe deposit box,” he recalled. “It took some time to research their value and find qualified buyers, but ultimately we were able to realize a substantial sum for the estate, far exceeding what the family had initially anticipated.”
This experience highlighted the unexpected treasures that can sometimes emerge during probate and the importance of having a skilled attorney who can navigate these complexities.
