Steve Bliss:
Certainly. One crucial step is selecting an executor or trustee. This individual will be responsible for managing your estate after your passing, ensuring your wishes are carried out and assets are distributed according to your plan.
Choosing the right person for this role requires careful consideration. Ordinarily, people select a close family member or trusted friend. However, it’s important to remember that this individual will be handling sensitive financial matters and potentially dealing with emotional situations. Consequently, you need someone who is responsible, organized, and capable of making sound decisions.
Moreover, it’s essential to discuss your wishes openly with the chosen individual. Ensure they understand their responsibilities and are willing to take on the task. You might also consider naming a successor executor or trustee in case the primary person is unable or unwilling to serve.
In my experience, selecting an executor can sometimes be emotionally charged. I recall one instance where a family was deeply divided over who should fulfill this role. The deceased had not explicitly named an executor, leading to disagreements among siblings. Ultimately, we were able to work through the conflict and reach a consensus that honored the wishes of the deceased as best as possible.
Nevertheless, these situations highlight the importance of clearly outlining your intentions in a will or trust document. Doing so can prevent future misunderstandings and potential family disputes.

That’s incredibly insightful, Steve. Are there any statistics about how often executors are named in wills?
Steve Bliss:
It’s estimated that roughly 60% of Americans don’t have a will. According to the American Bar Association, this means a significant number of estates lack a designated executor. This can lead to complications and delays in settling an estate.

What valuable advice would you offer our viewers about selecting an executor?
Steve Bliss:
My advice is to choose someone trustworthy, capable, and willing to take on the responsibility. Have an open and honest conversation with them about your wishes and expectations. And remember, it’s perfectly acceptable to name a successor executor in case your primary choice is unable to serve.
